{"id":5751,"date":"2026-03-25T14:28:35","date_gmt":"2026-03-25T14:28:35","guid":{"rendered":"https:\/\/thelawyerworld.com\/blog\/?p=5751"},"modified":"2026-07-06T10:20:51","modified_gmt":"2026-07-06T10:20:51","slug":"inside-the-growing-legal-reckoning-over-defective-medical-devices","status":"publish","type":"post","link":"https:\/\/thelawyerworld.com\/blog\/inside-the-growing-legal-reckoning-over-defective-medical-devices\/","title":{"rendered":"The Philips CPAP Recall: 15 Million Devices, $1.1 Billion in Settlements, and Claims Still Open"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">Philips recalled approximately 15 million CPAP, BiPAP and mechanical ventilator machines after becoming aware that the polyester-based polyurethane foam used within the machines was degrading and emitting small particles of industrial foam and chemicals used in the manufacturing process, which users could be inhaling or ingesting. The FDA received over <strong>105,000 medical device reports<\/strong> and <strong>385 death reports<\/strong> associated with the foam degradation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">So far, settlements included <strong>$1.075 billion<\/strong> for personal injury claims, <strong>$25 million<\/strong> for medical monitoring, and <strong>$479 million<\/strong> for economic loss class actions. As of mid-2026, 623 lawsuits are pending in MDL 3014 consolidated in the United States District Court for the Western District of Pennsylvania before Judge Joy Flowers Conti. New personal injury claims are still being accepted for users diagnosed with qualifying conditions.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What the Foam Was Doing Inside the Machines<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">PE-PUR is a noise-reducing foam that was used to dampen the motor noise in the Philips CPAP and BiPAP devices. However, the foam breaks down as it ages and when exposed to heat and humidity, conditions that naturally occur within a CPAP machine used on a nightly and continuous basis for hours at a time.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The foam would break down into small black dust, which users would inhale and sometimes swallow. The foam also emitted volatile organic compounds, including formaldehyde, diethylene glycol, and dimethyl diazene. Several of these compounds are known or suspected carcinogens, or likely to be carcinogenic in humans.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>How did users find out?<\/strong> Few did until the recall. Many saw black specks in their masks or tubing, and assumed they were dirt. Many people reported headaches, sinus congestion, nausea, vomiting, cough, and trouble breathing for weeks, months, or years before realizing that these symptoms were caused by the foam degradation. The recall notice went out in June 2021 but the FDA consent decree from April 2024 indicated knowledge of the foam breakdown internally years earlier.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That disparity between what was known internally and what was disclosed publicly is the gravamen of the personal injury litigation.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Three Separate Legal Tracks Running at the Same Time<\/h2>\n\n\n\n<figure class=\"wp-block-image size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"1002\" height=\"537\" src=\"https:\/\/thelawyerworld.com\/blog\/wp-content\/uploads\/2026\/03\/three-separate-legal-tracks-running-at-the-same-time.webp\" alt=\"\" class=\"wp-image-6462\" srcset=\"https:\/\/thelawyerworld.com\/blog\/wp-content\/uploads\/2026\/03\/three-separate-legal-tracks-running-at-the-same-time.webp 1002w, https:\/\/thelawyerworld.com\/blog\/wp-content\/uploads\/2026\/03\/three-separate-legal-tracks-running-at-the-same-time-300x161.webp 300w, https:\/\/thelawyerworld.com\/blog\/wp-content\/uploads\/2026\/03\/three-separate-legal-tracks-running-at-the-same-time-768x412.webp 768w, https:\/\/thelawyerworld.com\/blog\/wp-content\/uploads\/2026\/03\/three-separate-legal-tracks-running-at-the-same-time-60x32.webp 60w\" sizes=\"auto, (max-width: 1002px) 100vw, 1002px\" \/><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">As the CPAP litigation is actually three litigations, the order of payout would depend on which of the three litigations you were a part of.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Economic Loss Settlement ($479 million)<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The settlement also covers those who purchased one of the machines then had to pay for the machine, its replacement, and out-of-pocket costs. It was approved in September 2023. The deadline for refunds of recalled devices between 2008 and 2021 was August 9, 2024. This track has largely been completed.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Personal Injury Settlement ($1.075 Billion)<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">This is the big one. It covers anyone who developed qualifying medical conditions after using recalled devices. Respiratory illnesses, some cancers, inflammatory diseases, and organ damage. <strong>Registration deadline of January 31, 2025.<\/strong> Registrations were not extended. Claimants needing a known recalled device had to show proof of possession and serial number match, present medical records for a qualifying injury, and be a US citizen or resident.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">As of June 2026, the settlement administrators are processing verified claims. Those who completed verification in 2024 and early 2025 are expected to be in the first batch of payments. <strong>Over 58,000 claimants<\/strong> are in the queue.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Compensation amounts are based on the severity of the injury, duration of the device&#8217;s use, adequacy of medical documentation of injury, and evidence of causation. The Extraordinary Injury Fund operated from April to August 2025 to cover injuries that fell outside this tiered system.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Medical Monitoring ($25 Million Settlement)<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">This also establishes a Medical Advancement Program to study the long-term health effects of exposure to PE-PUR foam. The program covers approximately 4 million people affected by the recall. Nobody receives funds from this program, but the fund pays for the research and releases the results.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Philips Cannot Sell New CPAP Machines in the United States<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The April 2024 FDA consent decree not only requires oversight, but also prohibits Philips Respironics from manufacturing or marketing any new CPAP and BiPAP devices in the US until it has met remediation requirements. It is unclear how long this ban will remain in place.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The result is that the company, which is one of the largest CPAP manufacturers in the world, has been locked out of the US market while the court process and regulatory compliance are underway, leaving millions of sleep apnea patients who depended on its devices to scramble for replacement machines from ResMed, Fisher &amp; Paykel or other makers.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Philips Blames the SoClean Device for Contributing<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">One catch: SoClean, the maker of ozone-based CPAP cleaners, is being sued by Philips, which says that ozone accelerates the deterioration of the foam inside its otherwise-compatible machines.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Philips argues SoClean&#8217;s devices used an ozone cleaning method that it marketed aggressively to CPAP users for cleaning their devices. This cleaning method broke down the PE-PUR foam in a way that it would not have been broken down in normal use. Philips wants SoClean to share costs of the settlements.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Does this affect individual claimants?<\/strong> Not directly. The Philips-SoClean dispute is a dispute between two companies about who caused what. The personal injury settlement fund will exist no matter how that corporate battle plays out. But for CPAP users who relied on SoClean or another ozone cleaner, whether that cleaning device helped contribute to the foam degradation that caused their exposure may become relevant for cases that are not covered by the standard settlement tiers.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Who Can Still File a Claim<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">MDL 3014 is still open to accepting new personal injury plaintiffs. You can file a lawsuit if you used a recalled Philips CPAP or BiPAP machine and in 2023, 2024, 2025, or thereafter were diagnosed with cancer, developed a respiratory illness, or developed any of the other qualifying conditions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Each state has its own statute of limitations. In New York, plaintiffs have three years from the discovery or reasonable discovery of the connection between the injury and the device. For someone who gets cancer in 2024, and did not make the link to their CPAP until 2026, that surveillance clock is still ticking.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For New Yorkers with health complications caused by the recalled Philips device, the best way to take action is to consult a <a href=\"https:\/\/www.fuchsberg.com\/class-action-product-liability\/new-york-medical-device-lawyer\" target=\"_blank\" rel=\"noopener\">New York Medical Device Liability Lawyer<\/a>. The MDL process has strict deadlines and documentation requirements.
